1. Copyright & Usage
Ian Gordon Photography LLC retains full, exclusive copyright to all images produced. The Client is granted a non-exclusive license for personal use only (printing, sharing with family, personal social media).
Commercial Release: Clients may purchase a full copyright release for a flat fee, prices starting at $1,000 depending on the project. This fee will be invoiced separately. This transfer includes rights to high-resolution JPEG files for commercial use. It strictly excludes RAW (DNG/CR3) source files, which remain the sole property of the Photographer and are not available for purchase.
2. Model Release & Marketing
By booking a session, the Client grants Ian Gordon Photography LLC the irrevocable right to use the photographs for marketing, advertising, social media promotion (including but not limited to Instagram, Facebook, and the Photographer’s website), and portfolio usage.
Boudoir Exception: Boudoir photography is treated with strict confidentiality. Unlike standard sessions, boudoir images will not be published, posted to social media, or used in marketing materials without the Client's separate, explicit written permission. Your privacy in these sessions is paramount.
3. Privacy & Data Security
We implement industry-standard policies and practices to protect your personal information. We do not store sensitive financial data locally.
Data Handling:
- Session scheduling is securely hosted by Google Calendar. Your data is subject to Google's Privacy Policy.
- Payment processing is encrypted and handled exclusively by Stripe. Your financial data is subject to Stripe's Privacy Policy.
4. Cancellation & Non-Refundable Events
Session fees are non-refundable to compensate for the reservation of the Photographer's time. Fees may be transferred to a new date only if rescheduling is requested at least 48 hours prior to the session.
Non-Refundable Circumstances:
- Client Conduct: The Photographer reserves the right to terminate any session immediately without refund if the Photographer experiences harassment, threatening behavior, or unsafe conditions caused by the Client or their guests.
- Weather: In the event of inclement weather, the session will be rescheduled to the nearest mutually agreeable date. Refunds are not issued for weather delays.
- Force Majeure: No refunds will be issued for cancellations or delays due to Acts of God, fire, strike, or other causes beyond the control of the Photographer. In such cases, a credit toward a future session will be issued.
5. Dispute Resolution & Jurisdiction
Mandatory Arbitration: Any dispute, controversy, or claim arising out of or relating to this agreement, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules.
Jurisdiction: This agreement shall be governed by the laws of the Commonwealth of Virginia. The Client agrees that the exclusive jurisdiction and venue for any legal action or arbitration proceedings shall be the state and federal courts located within the State of Virginia.
