2. Intellectual Property and Copyright

All photographs, images, and content produced by Ian Gordon Photography are the exclusive property of iangordon.pro LLC.

• Copyright Ownership: The Photographer (Ian Gordon Photography) retains the entire copyright in the photographs and works of art pursuant to the Copyright Act of 1976 and all other applicable laws.

• Rights Reserved: All rights not expressly granted to the Client in writing are reserved exclusively to the Photographer.

3. Client Usage License

Upon final delivery of digital images, Ian Gordon Photography grants the Client a Perpetual Personal Use License.

• Permitted Uses: The Client may display the photos on personal social media, personal websites, and print the photos for personal use (e.g., home display, albums, gifts).

• Prohibited Uses: The Client may not sell, lease, or license the images to third parties. The Client may not use the images for any commercial purpose (including but not limited to advertising, resale products, or business promotion) without purchasing a separate Commercial Use License.

4. Artistic Rights and Modification

The Client agrees to respect the artistic integrity of the Photographer.

• No Modifications: The Client shall not modify, edit, crop, or apply filters (e.g., Instagram or TikTok filters) to the final delivered photos. Any modification of the images is a violation of the Photographer's artistic rights.

• Editing Style: The Photographer’s editing style is part of the artistic service; requests for re-editing may be subject to additional fees or refusal.

5. Commercial Use

Commercial use of any images is strictly prohibited unless a Commercial Package has been purchased. Commercial use includes, but is not limited to, use in brochures, business websites, book covers, or paid advertising. Fees for commercial use are determined based on the specific usage requirements.

6. Model Release and Marketing Use

By booking a session, the Client grants Ian Gordon Photography the irrevocable and unrestricted right to use and publish photographs of the Client for:

• Editorial, trade, and advertising purposes.

• The Photographer’s portfolio.

• Business marketing including, but not limited to, Facebook, Instagram, LinkedIn, and the Photographer’s website.

Boudoir Exception: The clause above does not apply to Boudoir photography. All Boudoir sessions require a separate, written Model Release form signed by the client before any images are shared publicly or used for marketing.

7. Governing Law and Dispute Resolution

• Jurisdiction: These Terms shall be governed by and construed in accordance with the laws of Washington, DC.

• Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to this Agreement or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration in Washington, DC.

• Exceptions: This arbitration clause applies except where prohibited by applicable state or federal laws and regulations.
